Statement of Claim

  • The Commonwealth of Massachusetts and the City of Boston are charging citizens for exercising a constitutional right.
    The cost to me, in actual money is $300 and in time approximately 15 hours for a total cost of $825($35 per hour).
    1. MA General Law Title XX Chapter 140 Section 131 requires that an applicant pay $100 application fee. Which I did to the City of Boston on 12/14/2018 at 9:43 am.

    2. Mass General Law Title XX Chapter 140 Section 131p and the City of Boston require that applicants obtain a Firearm Safety Certificate.
    Which I did on March 19, 2014, at a cost of $100 at the Mass Firearms School(MFA) in Holliston

    3. The State Law has no provision for low income people to relieve them of the financial burden it imposes if they need a gun for protection
    From a moral and ethical perspective the law should be voided.

    4. If the government is allowed to charge me for exercising my constitutional right than a person of greater wealth pays a smaller percentage
    of their assets for the right than I do and a low income person can't aford it.

    5. All of the above are a violation of an individual's constitutional rights

    6. This case is very simple. Either we have to pay for a Constitutional right or we do not. If we have to pay then some people are excluded.
    We have a moral and ethical obligation to correct this. Due to the simplicity of the case there is no need for depositions or interrogatories.

    7. The City will not accept the State Police approved MA Pistol License Class live fire certificate required for a License to Carry (LTC) as
    proof of fire arms competency. Instead as an additional cost in time, they require all applicants to go Moon Island in Quincy MA. for a
    "live fire course" and "short classroom lecture". I am willing to do this if they pay me for the time.

    8. The gun used in the "live fire course" is a .38 calibur 4-inch barrel revolver which is very similar to the "6 shooter" used by John Wayne
    in his movies. In oder to learn how to load and shoot that gun I had to take an additional session at the MFA school. This required an
    additional two hours of travel time plus one hour of practice at a cost of $100.
